Care of Duty

All businesses have a responsibility and duty of care to know where their waste is going, who is dealing with it and that it is being dealt with legitimately. This means that if you pay a company to collect waste from you and they subsequently fly-tip it then you could be legally liable. It is very important you check that any company that collects and ultimately disposes or treats your waste has a valid waste carriers/brokers/management licence. As well as a legal responsibility, companies have a moral duty to make sure their waste is dealt with properly.

The UK authorities are aware that some organisations are illegally and unethically sending rubbish to developing countries where it can potentially pollute the waterways, soil and atmosphere and be a danger to children and adults alike. The authorities have successfully prosecuted companies for such activities. WEEE cannot be exported for disposal and Hazardous WEEE cannot be exported for recovery to countries outside the OECD.
